On study and teaching of aesthetics in Vietnam.

This paper examines Jacques Derrida's deconstruction of Giorgio Agamben's account of the history of bio-politics in the Beast and the Sovereign. In this account, the ‘threshold of bio-political modernity’ is identified with the collapse of an allegedly immemorial distinction between life and the law. According to Derrida, however, this in-distinction between life and the law, which supposedly marks the historical emergence of the bio-political, is in fact an originary event. Agamben, therefore, announces a bio-political modernity that has always already existed. (...) In this essay, I argue that Derrida, in the Beast and the Sovereign, fails to grasp the significance of one of the principal figures employed in Agamben's theory of the bio-political, the ‘threshold’. This figure, which Agamben opposes, elsewhere in his writings, to the Derridean notion of difference/deferral, does not refer to either an historical beginning or something that has always already existed. Rather, the threshold is defined as a particular moment in which an originary phenomenon becomes a decisive historical norm. In his ‘history’ of the bio-political, therefore, Agamben identifies the modernity of the latter in terms of the historical normalization of an in-distinction between law and life that has always already occurred. Crime victims are forgotten in criminal proceedings. Criminal justice systems tend to treat crime victims quite poorly, but, when they deal with child victims, their frequent failure to respect the child’s rights finds no excuse. Law enforcement and criminal justice interventions made in the name of protecting children against violent crime often fail to consider what is truly in the best interests of the child and end up further victimizing the child victims. Vietnam has instituted justice reforms that recognize the (...) need for special measures to protect the rights of child victims and witnesses of crime. This article reviews the progress achieved in implementing these reforms and points at several areas where implementation has been slow or further reforms are needed. Based on a comparative legal analysis, the article exemplifies how legal semiotics can contribute to an understanding of the complexity of policy transfer in the area of justice and human rights. Interpretation at the argumentative level, like action selection in response to environmental change, requires decision-making based on context construction. By boosting the efficiency of this process, discourse markers keep variations in the interlocutor's processing context within a certain range.

This essay considers Deleuze and Guattari’s paradoxical claim that Marx’s critique of political economy implies as a universal history derived from the singular features of capitalism. In this critique, capitalism is defined by the commodity form, as a relationship of economic equivalence that replaces the bonds of dependence underlying other social formations. By negating relations of kinship and caste, capitalism reveals, a contrario, the universal foundation of other societies. As the “negative of all social formations,” capitalism conditions a universal history, (...) defined, retrospectively, from the singular standpoint of a society, based upon the negation of kinship and caste. In this universal history, moreover, the negation of capitalism is identified with the possibility of a new and equally singular form of society. In Anti-Oedipus, the latter is defined as a “schizophrenic” condition liberated from the commodity as well as from the bonds of dependence that constituted the universal foundation of earlier societies. The study of context can benefit greatly from re-examining some of the concepts arising from Anscombre and Ducrot’s argumentation theory from an adaptive perspective. By focusing on discourse dynamism, AT provides fresh angles from which to view key issues, such as the nature of context triggers; whether context construction is necessarily a background activity; in what way utterances set themselves up as contexts for the upcoming discourse; and the nature of the inferences whereby background knowledge and information are accessed. The (...) need for an adaptive perspective arises in connection with AT’s construal of context construction, which raises but cannot answer certain questions that are crucial to our understanding of context: these questions concern the source of the background knowledge required to understand the argumentative meanings under consideration. An adaptive perspective can offer a non-ad-hoc account of the source of the background knowledge involved, in terms of what pre-existing systems require to support their processing needs, and the information and knowledge they produce. Such an account builds on the assumptions that language can avail itself of processing strategies, skills, forms of know-how utilised by pre-existing systems, and has access to knowledge generated by systems such as perception and action production. Despite its importance, abnormal interactions between the proximal and distal upper extremity muscles of stroke survivors and their impact on functional task performance has not been well described, due in part to the complexity of upper extremity tasks. In this pilot study, we elucidated proximal–distal interactions and their functional impact on stroke survivors by quantitatively delineating how hand and arm movements affect each other across different phases of functional task performance, and how these interactions are influenced by stroke. Fourteen subjects, (...) including nine chronic stroke survivors and five neurologically-intact subjects participated in an experiment involving transport and release of cylindrical objects between locations requiring distinct proximal kinematics. Distal kinematics of stroke survivors, particularly hand opening, were significantly affected by the proximal kinematics, as the hand aperture decreased and the duration of hand opening increased at the locations that requires shoulder abduction and elbow extension. Cocontraction of the extrinsic hand muscles of stroke survivors significantly increased at these locations, where an increase in the intermuscular coherence between distal and proximal muscles was observed. Proximal kinematics of stroke survivors was also affected by the finger extension, but the cocontraction of their proximal muscles did not significantly increase, suggesting the changes in the proximal kinematics were made voluntarily. Our results showed significant proximal-to-distal interactions between finger extension and elbow extension/shoulder abduction of stroke survivors exist during their functional movements. Increased cocontraction of the hand muscles due to increased neural couplings between the distal and proximal muscles appears to be the underlying mechanism. (shrink)

This book offers an innovative approach to the analysis of the current crisis in the South China Sea. Moving beyond the spirit of the UN Convention on the Law of the Sea (UNCLOS), the mechanisms of which are limited to physical geography, it demonstrates how epistemological insights from the field of critical realist philosophy can reveal the importance of cultural and structural conditioning processes in social interactions, processes which shape the conditions for the emergence of crisis points along a spectrum (...) of conflict and cooperation. The potential for conflict resolution and the emergence of new regions in Pacific Asia much depends on the nature of such interactions at many levels (political-economic, semiotic and cultural) based on perceptions of what constitutes the "common" versus a Sinicised version of "Lebensraum". This paper explores the relationship between revolution and corruption in Jean Genet’s accounts of the Palestinian movement in his final work, Prisoner of Love. For Genet, corruption does not simply expose the actions of a revolutionary subject as an empty impersonation, performed for the actual ends of acquiring personal power and fortune. Rather, it exposes the ‘pretension’ inherent in the revolution it undermines as well as in the accumulation of value. For Genet, the misappropriation of money by the Palestinian leadership (...) makes manifest the imaginary character of both devotion to a revolutionary cause and greed for the commodity-fetish. Corruption, in other words, betrays revolution as well as the ‘imaginary wealth and power’ which the ‘game of revolution’ attempts to destroy. (shrink)

Liquid‐liquid phase separation (LLPS) has recently emerged as a possible mechanism that enables ubiquitin‐binding shuttle proteins to facilitate the degradation of ubiquitinated substrates via distinct protein quality control (PQC) pathways. Shuttle protein LLPS is modulated by multivalent interactions among their various domains as well as heterotypic interactions with polyubiquitin chains. Here, the properties of three different shuttle proteins (hHR23B, p62, and UBQLN2) are closely examined, unifying principles for the molecular determinants of their LLPS are identified, and how LLPS is connected (...) to their functions is discussed. Evidence supporting LLPS of other shuttle proteins is also found. In this review, it is proposed that shuttle protein LLPS leads to spatiotemporal regulation of PQC activities by mediating the recruitment of PQC machinery (including proteasomes or autophagic components) to biomolecular condensates, assembly/disassembly of condensates, selective enrichment of client proteins, and extraction of ubiquitinated proteins from condensates in cells. Entrepreneurship plays an indispensable role in the economic development and poverty reduction of emerging economies like Vietnam. The rapid development of technologies during the Fourth Industrial Revolution (Industry 4.0) has a significant impact on business in every field, especially in the innovation-focused area of entrepreneurship. However, the topic of entrepreneurial activities with technology applications in Vietnam is under-researched. In addition, the body of literature regarding entrepreneurial finance tends to focus on advanced economies, while mostly neglecting the contextual differences in developing (...) nations. Therefore, this research contributes to these topics by investigating the main characteristics of a high potential market for entrepreneurs in Vietnam, which is the English language training market (ELTM). It also aims at indicating the impacts of technology on the entrepreneurial firms within this market, with an emphasis on financing sources. To answer the research questions, this study employs a qualitative analysis and conducts 12 in-depth, semi-structured interviews with entrepreneurs and researchers in the field. The key findings in our study highlight the main contributing factors to the growth of the market, both universally and context-specific for a developing nation like Vietnam. It also lists the leaders in each market segment and the industry’s potential profit margin. The results also show that most entrepreneurs in the ELTM utilized private sources of finance rather than external ones, such as bank loans. It again confirms the idea from previous works that even with the rapid development of the economic and technological landscape, entrepreneurial activities in general barely benefit from additional sources of funding. However, it also points out the distinct characteristics of the ELTM that may influence these financing issues; for example, English training services usually collect revenues from customers before delivering their classes. This is of advantage for entrepreneurs in this area and helps significantly reduce the financial barriers. These findings, which are among the first attempts to contribute to a better understanding of entrepreneurial opportunities in the Industry 4.0 in Vietnam, provide valuable insights for policymakers and entrepreneurs, as well as investors. During the last two decades Confucian heritage culture countries have widely promoted teaching and learning reforms to advance their educational systems. To skip the painfully long research stage, Confucian heritage culture educators have borrowed Western philosophies and practices with the assumption that what has been done successfully in the West will produce similar outcomes in the East. The wide importation of cooperative learning practices to Confucian heritage culture classrooms recently is an example. However, cooperative learning has been documented in many (...) studies not to work effectively in Confucian heritage culture classrooms. The reason is that the educators often impose this instructional method on the students without a careful consideration of its appropriateness in the socio-cultural context of Confucian heritage culture countries. This procedure is not effective and professional because learning does not stand alone. Rather, it is shaped and influenced by other factors including teaching methods, learning tasks, assessment demands, workload and the learning culture of students in the local context. For cooperative learning to work effectively in Confucian heritage culture classrooms, reformers need to consider the importation of this approach in line with a careful examination of all supports and constraints that affect those factors that are associated with learning. The volume provides an applied theoretical framework and culturally appropriate and practical instructions that could assist Confucian heritage culture educators and teachers to address various factors at multiple levels in order to optimize success in importing cooperative learning to their classrooms. Overall, it provides strategies to assist Confucian heritage culture teachers to change their teaching practices, redesign lessons plans, design assessment methods, and organize learning activities in a manner that can influence Confucian heritage culture students to shift from employing teacher-centered learning approaches to cooperative learning. We present an argument-based formalism of contract dispute resolution following a modern view that the court would resolve a contract dispute by enforcing an interpretation of contract that reasonably represents the mutual intention of contract parties. Legal doctrines provide principles, rules and guidelines for the court to objectively arrive at such an interpretation. In this paper, we establish the appropriateness of the formalism by applying it to resolve disputes about performance relief with the legal doctrines of impossibility and frustration of (...) purpose in common laws of contract. The formalism is based on modular argumentation, a recently proposed extension of assumption-based argumentation for modelling contract dispute resolution. (shrink)

The purpose of the study is to explore the in-depth understanding of participants' journeys from helplessness to resilience and post-traumatic growth during COVID-19. The participants’ experiences are taken into consideration and examined in depth. To do so, we employ a phenomenological methodology which is concerned particularly with individual experiences and is exploratory. 90 participants (17 males, 72 females, and the other 1, aged 18-52) were invited to participate in the survey with two self-report questions. The participants’ levels of education include: (...) graduate (n=66), postgraduate (n=18), college (n=1), and others (n=3) were willingly shared their experiences focusing on two self-report questions on personal diaries and 1) Naming an incident during the COVID-19 pandemic that has impacted you? 2) What is your greatest support to overcome adversity during the pandemic? We found four key themes: (1) feelings of helplessness, including confusion, meaninglessness, and disconnection; (2)Theme 2: Finding Inner Strength and Personal Resources (e.g., awareness of self-efficacy ); (3) Theme 3: Having Family and Community Support (e,g., appreciation of others, ability for adaptation); and (4) Theme 4: Belief in the Divine Presence (e.g., attunement to priorities). These findings offer valuable implications for the field of Evolutionary Studies in Imaginative Culture. (shrink)

No século XXI, o mundo se depara com grandes desafios políticos em relação à cultura, à sociedade e, especialmente, ao meio ambiente, não obstante desfrutar de brilhantes conquistas na ciência e na tecnologia, e, sobretudo, naeconomia. Observa-se que estesdesafios aumentam cada vez mais, e afetam a sobrevivência humana. Desse modo, buscar o desenvolvimento sustentável deve se tornar o objetivo central nas políticas de cada país.De acordo com a ideia de desenvolvimento social, segundo o pensamento de Ho Chi Minh, as decisões (...) políticas devem partir do povo, uma vez que é ele próprio o sujeito da história. Nas sendas deste pensamento, destacamos o papel do povo vietnamita, ligado profundamente ao desenvolvimento sustentável. Todo esforço deve consistir no trabalho de organizar os recursos do povopara desenvolver o país. Nesse sentido, o pensamento de Ho Chi Minh sobre a organização social não deve se valer, apenas, daqueles que participaram da revolução pela independência do Vietnã, mas deve se dar como força motriz para o desenvolvimento sustentável. Isto posto, temos que,junto àideia de desenvolvimento sustentável, é necessário desenvolver outros setores como a economia, a cultura e a sociedade, promovendo o estado de bem-estar social, elevando o Vietnã ao estágio de desenvolvimento de outros países.Nessa toada, o crescimento econômico deve refletir o progresso e a justiça social, traduzido em qualidade de vida e erradicação da pobreza. Assim, nosso objetivo neste artigo é investigar acerca das condições de aplicabilidade das ideias políticas de Ho Chi Minh sobre o papel do povo como sujeito do progresso, a fim de termos uma base de discussão sólida para a propositura de umprograma de desenvolvimento sustentável no Vietnã hoje. Human contact is a key issue in social interactions for autonomous systems since robots are increasingly appearing everywhere, which has led to a higher risk of conflict. Particularly in the real world, collisions between humans and machines may result in catastrophic accidents or damaged goods. In this paper, a novel stop strategy related to autonomous systems is proposed. This control method can eliminate the vibrations produced by a system’s movement by analysing the poles and zeros in the model of autonomous (...) vehicles and goods. Using the pole placement technique, the motion of a system is guaranteed to be more stable, more flexible and smoother. Moreover, several control profiles are employed in the switching mechanism to choose the proper vibration-free effect. The main contributions of this paper are the recommendation of an active stopping planner using different smooth generators from a modelling study, the validation of their physical characteristics and the launching of a switching algorithm based on the socially aware navigation framework of a robot. This theoretical work is based on the virtual environment of MATLAB, and the experiment is implemented in the practical platform of an automated guided vehicle. From these results, it can be seen that the proposed approach is robust, effective and feasible for applications in storehouse management, public transportation or factory manufacturing. (shrink)

To demonstrate some manifestations of the integration of Vietnamese literature (in the case of Hồ Biểu Chánh), specifically with French literature, this paper will highlight the intersection of global and national characteristics in Vietnamese literature at that time, particularly in Hồ Biểu Chánh's adaptation of French literary works. Additionally, the paper employs analytical and synthetic methods to break down the research problems, thereby providing a clearer understanding of Hồ Biểu Chánh's unique features. This approach emphasizes the inheritance, development, and originality (...) in certain aspects of Hồ Biểu Chánh's integration with world literature in the early 20th century. (shrink)

In this chapter, we aimed at further characterizing the functional neuroanatomy of the human rapid eye movement (REM) sleep at the population level. We carried out a meta-analysis of a large dataset of positron emission tomography (PET) scans acquired during wakefulness, slow wave sleep and REM sleep, and focused especially on the brain areas in which the activity diminishes during REM sleep. Results show that quiescent regions are confined to the inferior and middle frontal cortex and to the inferior parietal (...) lobule. Providing a plausible explanation for some of the features of dream reports, these findings may help in refining the concepts, which try to account for human cognition during REM sleep. In particular, we discuss the significance of these results to explain the alteration in executive processes, episodic memory retrieval and self representation during REM sleep dreaming as well as the incorporation of external stimuli into the dream narrative. The annotated dataset is an essential requirement to develop an artificial intelligence system effectively and expect the generalization of the predictive models and to avoid overfitting. Lack of the training data is a big barrier so that AI systems can broaden in several domains which have no or missing training data. Building these datasets is a tedious and expensive task and depends on the domains and languages. This is especially a big challenge for low-resource languages. In this paper, we experiment (...) and evaluate many various approaches on sentiment analysis problems so that they can still obtain high performances under limited training data. This paper uses the preprocessing techniques to clean and normalize the data and generate the new samples from the limited training dataset based on many text augmentation techniques such as lexicon substitution, sentence shuffling, back translation, syntax-tree transformation, and embedding mixup. Several experiments have been performed for both well-known machine learning-based classifiers and deep learning models. We compare, analyze, and evaluate the results to indicate the advantage and disadvantage points of the techniques for each approach. The experimental results show that the data augmentation techniques enhance the accuracy of the predictive models; this promises that smart systems can be applied widely in several domains under limited training data. As the first empirical study of the nonlinear effects of digital business on global value chains (GVC), we provide insight into the nonlinear effects of digital business on the global value chain (GVC) values. We employ four indicators, including the value of online selling, sales through E-commerce, and customer relationship management (CRM) usage, to capture the prevalence of digital business in the economy. By testing a sample of 25 European countries that have been analyzed using various econometric techniques over the (...) period 2012–2019, our estimation results confirm that GVC values are a U-shaped function of digitalization. That is, an increase in digitalization pervasiveness initially induces more significant risks and uncertainties, hindering European countries from getting involved in or scale-up within the GVC. However, a rise in digitalization pervasiveness goes beyond a specific threshold, which facilitates GVC activities as more opportunities are created. Furthermore, our findings suggest that digital business contributes significantly to reducing the adverse influences of global uncertainty on the GVC values, while the marginal effects of digital business on GVC values become more pronounced in countries with the most advanced institutional structure. This paper argues for the contemporary significance of the ‘Critique of Violence’ by proposing a Benjaminian reading of two important analyses of the relationship between history, politics and the Rights of Man: Hegel’s account of the French Revolution and the concept of dissensus proposed by Jacques Rancière. For both Hegel and Rancière, the gap between right and reality – between the ideal of equality, for example, and the existence of concrete inequality – does not warrant a rejection of the Rights (...) of Man. Rather, the gap is a constitutive condition of law and political rights. From the perspective of Benjamin’s ‘Critique of Violence’, however, these analyses serve to perpetuate a bourgeois legality, one that both Hegel and Rancière acknowledge can never be realized due to the constitutive discrepancy between right and reality. In preserving the promise of legal equality, these analyses preclude the possibility of a suspension or ‘absolution’ from law. This suspension of law is a task that Benjamin identified with the proletarian general strike, a strategy whose pure violence is supposed to secure what Benjamin described, enigmatically, as a ‘wholly transformed work’. Remarkably, however, the relationship between the suspension of law in a general strike and a total transformation of labour is never clearly defined in the ‘Critique’. This paper will develop an account of this relationship by pursuing the references to Marx’s critical theory of capitalism in Benjamin’s writings. (shrink)

In the current era, robots and artificial agents can do jobs that could only be achieved with human creativity in the past, therefore successfully stepped into the sacred territory that once considered exclusive to human. Given this situation, Mark Amerika made two significant contributions with his new book, “My life as an Artificial Creative Intelligence”. This book added to the emerging literary genre collaborated by human artists and AI, telling the story about the advanced ACI developed in the project FATAL (...) ERROR and its relationship with Amerika as its co-author and creator. Moreover, this book documented an in-depth investigation into the nature of creativity and its processes, asking whether creativity is exclusive to the human mind. (shrink)

Social security is one of the important guidelines and policies of our Party and State that has been thoroughly grasped and guaranteed to be implemented during the country's development periods. In recent years, despite facing many difficulties and challenges, social security work in Vietnam has continued to achieve many positive results, policies have continuously improved, the material and spiritual life of people has improved. People are cared for better and better with the goal of "leaving no one behind".

This is an account of a reading project that began in February 2020. Australia was burning, a pandemic was simmering, the two of us were early in our PhD journeys at the Melbourne Law School. Already, we felt exhausted by critical theory which seemed to amplify the affects we felt all too intensely. Our reading project began as an attempt to find and inhabit texts that might move beyond critique, that might allow us to find wonder and vitality in legal (...) theory. Taking up the literary critic Rita Felski’s invitation to craft a post-critical reading practice, our reading list evolved iteratively to encompass themes and concerns that we identified as possibly correlating with said practice. It evolved too, in conversation with Melbourne, as the city journeyed through different stages of the pandemic. Constantly changing restrictions changed the ways in which we met and conversed, influencing in turn the texts we chose to read and the manner in which we read them. In this account, we pay attention to the time and place of our encounters with these interlocutors, and to the feelings these encounters generated. As such, this article takes the form of a series of (revised) diary entries: first written in 2020, then revisited in the corresponding months of 2021. What we hope emerges from these entries is a sense of how these theoretical texts train us to live in a world undergoing a compounding series of crises – and, perhaps, to imagine that world otherwise. In a more jurisprudential register, we hope that our experiment will identify the methods these texts might give us for (re-)engaging with law in a spirit of wonder and vitality. (shrink)

Antimicrobial resistance (AMR) is a global public health disaster driven largely by antibiotic use in human health care. Doctors considering whether to prescribe antibiotics face an ethical conflict between upholding individual patient health and advancing public health aims. Existing literature mainly examines whether patients awaiting consultations desire or expect to receive antibiotic prescriptions, but does not report views of the wider public regarding conditions under which doctors should prescribe antibiotics. It also does not explore the ethical significance of public views (...) or their sensitivity to awareness of AMR risks or the standpoint (self-interested or impartial) taken by participants. Methods: An online survey was conducted with a sample of the U.S. public (n = 158). Participants were asked to indicate what relative priority should be given to individual patients and society-at-large from various standpoints and in various contexts, including antibiotic prescription. Results: Of the participants, 50.3% thought that doctors should generally prioritize individual patients over society, whereas 32.0% prioritized society over individual patients. When asked in the context of AMR, 39.2% prioritized individuals whereas 45.5% prioritized society. Participants were significantly less willing to prioritize society over individuals when they themselves were the patient, both in general (p = .001) and in relation to AMR specifically (p = .006). Conclusions: Participants’ attitudes were more oriented to society and sensitive to collective responsibility when informed about the social costs of antibiotic use and when considered from a third-person rather than first-person perspective. That is, as participants came closer to taking the perspective of an informed and impartial “ideal observer,” their support for prioritizing society increased. Our findings suggest that, insofar as antibiotic policies and practices should be informed by attitudes that are impartial and well-informed, there is significant support for prioritizing society.
